BookOnMe Terms of Service

These Terms of Service govern access to and use of the BookOnMe platform, website, applications, booking interfaces, APIs, content, and related services (collectively, the "Platform").

The Platform is operated by BookOnMe, a technology provider offering digital infrastructure that enables users to discover venues, request reservations, purchase tickets, access memberships, participate in loyalty or promotional programs, and interact with independent venues, merchants, service providers, and organizers.

By accessing or using the Platform, or by completing any booking, reservation, ticket purchase, membership registration, subscription, or related transaction through the Platform, you agree to be bound by these Terms, as well as the BookOnMe Privacy Policy and any other policies or notices published on the Platform.

If you do not agree to these Terms, you must not access or use the Platform.

1. Platform Nature

BookOnMe provides technology infrastructure enabling booking, reservation management, ticketing, membership access, payment flows, loyalty integrations, and related user interactions between users and independent venues or organizers.

BookOnMe does not:

  • own or operate venues
  • host events
  • provide hospitality services
  • manage ticketed experiences
  • operate third-party membership or loyalty programs
  • control the actual delivery of services offered by venues or organizers

All services listed or made available through the Platform are provided directly by independent venues, merchants, or organizers.

2. User Eligibility and Account Responsibilities

Users must:

  • be at least 18 years old, or the age of legal majority in their jurisdiction
  • provide accurate, complete, and current information
  • comply with applicable laws and regulations
  • comply with venue and organizer policies
  • maintain the confidentiality of their account credentials

Users are responsible for all activity conducted through their account.

BookOnMe reserves the right to suspend, restrict, or terminate accounts that violate these Terms, applicable law, or platform policies.

3. Limited License to Use the Platform

Subject to these Terms, BookOnMe grants users a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for its intended personal or internal business purposes.

This license does not transfer any ownership rights in the Platform or its content.

Except as expressly permitted in writing by BookOnMe, users may not:

  • reproduce, copy, distribute, republish, or commercially exploit any portion of the Platform
  • modify, adapt, translate, or create derivative works from the Platform or its content
  • use the Platform or its materials for public display or unauthorized commercial purposes
  • reverse engineer, decompile, disassemble, or attempt to extract source code from any software or systems used in the Platform, except where such restriction is prohibited by applicable law
  • remove, alter, or obscure any copyright, trademark, branding, or other proprietary notices
  • mirror, frame, scrape, index, or reproduce the Platform on any other server, website, or service
  • use automated systems, bots, scripts, crawlers, or similar tools to access the Platform in a manner that imposes unreasonable load or extracts data without authorization
  • interfere with the Platform's security, integrity, availability, or operation

Any unauthorized use automatically terminates the license granted under these Terms.

4. Intellectual Property

The Platform, including its design, software, source and object code, text, graphics, user interface elements, logos, trademarks, service marks, trade names, databases, booking flows, content organization, and other materials, is owned by or licensed to BookOnMe and is protected by applicable intellectual property, copyright, trademark, database, and unfair competition laws.

Nothing in these Terms grants users any ownership interest in the Platform or in any BookOnMe intellectual property, except for the limited right to use the Platform as expressly stated in these Terms.

All rights not expressly granted are reserved by BookOnMe.

5. Booking Process

Bookings through the Platform may include:

  • instant confirmations
  • reservation requests
  • ticket purchases
  • membership registrations
  • subscriptions
  • loyalty or promotional participation

A confirmed booking or purchase creates a direct service relationship between the user and the venue or organizer providing the relevant service, unless expressly stated otherwise.

BookOnMe acts solely as a technical intermediary unless expressly stated otherwise.

6. External Venue Requests

Users may submit booking requests to venues that are not directly integrated into the core BookOnMe booking system.

In such cases:

  • 1. the Platform may transmit the request to the venue
  • 2. the venue may accept or decline the request
  • 3. if accepted, the user may receive a confirmation link or follow-up instructions

BookOnMe does not guarantee acceptance, availability, or fulfillment of such requests.

7. Pricing and Fees

Prices for services are determined by the venue or organizer. BookOnMe may apply booking fees, confirmation fees, platform service fees, or payment-related processing fees, where disclosed at checkout.

8. Venue Policies

Venues and organizers determine their own:

  • cancellation policies
  • refund eligibility
  • entry requirements
  • reservation rules
  • membership conditions
  • event access policies
  • operating procedures

Users agree to comply with all venue or organizer rules applicable to their booking or purchase.

9. Cancellation and Refund Policy

This section governs the cancellation, modification, refund, and related procedures for reservations, ticket purchases, memberships, subscriptions, event access, loyalty participation, and other services booked or purchased through the Platform.

9.1 Role of BookOnMe

BookOnMe acts solely as a booking facilitation and technology provider that enables users to:

  • make reservations at restaurants, hospitality venues, or entertainment spaces
  • purchase tickets for events, shows, or experiences
  • register for memberships or subscriptions offered by venues
  • participate in loyalty programs or promotional campaigns
  • submit reservation requests to third-party venues

All services offered through the Platform are provided directly by the venue or organizer, which remains solely responsible for the execution, delivery, modification, cancellation, or fulfillment of the service.

BookOnMe does not guarantee the availability, quality, safety, legality, or fulfillment of any service listed on the Platform.

9.2 Venue and Organizer Responsibility

Each venue or organizer determines its own:

  • reservation rules
  • ticketing conditions
  • cancellation policies
  • refund eligibility
  • entry requirements
  • service terms
  • event schedules
  • membership terms

When a booking is completed, the user enters into a direct contractual relationship with the venue or organizer, not with BookOnMe, except to the limited extent of any platform-related services provided directly by BookOnMe.

The venue or organizer remains solely responsible for:

  • delivering the booked service
  • handling cancellations or rescheduling
  • providing refunds where applicable
  • managing capacity or operational changes
  • complying with local laws and regulations

BookOnMe cannot modify, override, or enforce the policies of individual venues or organizers, except where required by applicable law or where expressly stated by the Platform.

9.3 Reservation Cancellations

Reservation cancellation rules are determined by the venue.

Venues may apply policies including, without limitation:

  • free cancellation up to a specified time before the reservation
  • partial refund or credit policies
  • no-show fees
  • non-refundable reservations
  • deposit requirements
  • late cancellation penalties

If a user cancels a reservation within the timeframe permitted by the venue, any refund or credit will be processed according to the venue's policy.

If a cancellation occurs outside the permitted window, the venue may retain the deposit or charge the applicable cancellation fee.

BookOnMe does not determine or enforce these conditions, except where the Platform expressly displays or administers such terms on behalf of the venue.

9.4 Event Tickets

Tickets purchased through BookOnMe may be subject to event-specific rules defined by the organizer.

Unless otherwise stated:

  • tickets may be non-refundable once issued
  • tickets may be non-transferable
  • entry may be subject to identification, venue rules, timing restrictions, or organizer requirements

If an event is postponed, rescheduled, or cancelled, the organizer is responsible for determining whether:

  • tickets remain valid for a new date
  • refunds will be issued
  • credits or replacements will be offered

BookOnMe facilitates the ticketing process but does not control event execution or refund decisions made by the organizer.

9.5 Memberships and Subscriptions

Memberships, subscriptions, or access passes offered through the Platform are managed by the venue providing the service.

Terms regarding:

  • cancellation
  • renewal
  • refunds
  • freeze periods
  • suspension
  • termination

are determined exclusively by the venue, unless expressly stated otherwise on the Platform.

BookOnMe provides the technical infrastructure enabling the purchase or management of memberships, but does not operate the membership program itself unless expressly stated otherwise.

9.6 Loyalty Programs

Loyalty programs integrated with the Platform may allow users to accumulate points, benefits, discounts, rewards, or other promotional advantages.

These programs are administered by the participating venue or merchant, unless expressly stated otherwise.

BookOnMe does not guarantee:

  • availability of rewards
  • continuity of any program
  • redemption options
  • program duration
  • maintenance of specific point values or benefits

Venues or merchants may modify, suspend, or terminate loyalty programs at any time, subject to applicable law.

9.7 Platform Fees

In certain cases, BookOnMe may charge a booking fee, confirmation fee, platform service fee, or similar charge. Such fees are associated with the use of the Platform infrastructure and booking technology. Unless otherwise required by applicable law, such fees are generally earned upon booking confirmation or processing and are non-refundable, even where a venue later issues a refund or a booking is cancelled. Nothing in these Terms limits any mandatory refund, cancellation, withdrawal, or other consumer rights available under applicable law. These fees may cover operational costs including payment processing, infrastructure services, booking verification, fraud prevention systems, and customer support administration.

9.8 Venue-Initiated Cancellations

A venue or organizer may cancel or modify a reservation, event, or service due to:

  • operational reasons
  • capacity limitations
  • force majeure events
  • safety considerations
  • government restrictions
  • technical failures
  • scheduling conflicts

In such cases, the venue or organizer determines whether refunds, credits, rescheduling, or alternative arrangements will be provided, subject to applicable law.

BookOnMe acts only as the communication and technology intermediary unless expressly stated otherwise.

9.9 User No-Shows

If a user fails to appear at a reservation, event, or booked service without cancelling within the permitted timeframe, the venue may apply:

  • a no-show fee
  • retention of deposit
  • cancellation of associated bookings
  • refusal of future reservations

Repeated no-shows may also lead to temporary or permanent account restrictions on the Platform.

9.10 Refund Processing

Where a refund is approved by the venue, organizer, or BookOnMe, as applicable, the refund will generally be returned through the original payment method, unless otherwise required or permitted by applicable law.

Refund processing times may depend on:

  • the venue's decision and timing
  • the payment service provider
  • card network rules
  • the issuing bank or financial institution

BookOnMe is not responsible for delays caused by third-party payment processors or financial institutions.

10. Payments Policy

Payments made through the Platform may be processed by third-party payment service providers, including Worldline or other licensed financial institutions.

BookOnMe does not store full payment credentials unless expressly stated and handled in accordance with applicable law and its Privacy Policy.

Transactions may be subject to validation, fraud screening, identity verification, and payment authorization procedures.

BookOnMe may suspend, reject, or cancel transactions that appear suspicious, unauthorized, unlawful, or inconsistent with platform risk controls.

11. Chargeback and Dispute Policy

A chargeback occurs when a cardholder disputes a transaction with their issuing bank or payment provider.

Chargebacks may arise from:

  • unauthorized transactions
  • service disputes
  • duplicate charges
  • cancellation disagreements
  • alleged fraud

Any dispute relating to service quality, cancellations, event execution, reservation handling, or venue policy must first be raised with the relevant venue or organizer.

When a chargeback or payment dispute occurs, BookOnMe may provide relevant transaction information to payment providers, banks, card networks, or dispute-resolution entities, including:

  • booking confirmation records
  • timestamped transaction logs
  • venue policy disclosures presented during checkout
  • user account activity
  • payment authorization data
  • communications relevant to the transaction

This information may be used for transaction verification, fraud prevention, or dispute response.

Users who initiate repeated or abusive chargebacks without reasonable basis may face:

  • account suspension
  • restrictions on future bookings
  • permanent removal from the Platform
  • additional verification requirements for future transactions

Nothing in this section limits a user's non-waivable rights under applicable law.

12. Prohibited Conduct

Users must not use the Platform to:

  • commit fraud or facilitate unauthorized transactions
  • submit false or misleading booking information
  • abuse promotional systems, loyalty features, discounts, refunds, or chargeback procedures
  • disrupt venue operations or other users' access to the Platform
  • upload, transmit, or distribute malicious code or harmful content
  • violate any applicable law, third-party right, or contractual restriction

BookOnMe may investigate suspected misuse and may suspend access, cancel transactions, or restrict accounts where reasonably necessary to protect the Platform, users, venues, or payment systems.

12A. Indemnity

You agree to indemnify, defend, and hold harmless BookOnMe, its affiliates, officers, directors, employees, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your misuse of the Platform, your breach of these Terms, your violation of applicable law, your fraud or misconduct, or your infringement of any third-party rights.

13. Third-Party Services and Links

The Platform may contain links to third-party websites, services, content, payment providers, venue pages, social media pages, maps, advertisements, or integrations that are not owned or controlled by BookOnMe.

Such links are provided for convenience only.

BookOnMe does not endorse, guarantee, or assume responsibility for the content, availability, accuracy, legality, privacy practices, or services of any third-party website or service.

Access to third-party sites or services is at the user's own risk and subject to the terms and policies of those third parties.

14. Privacy

Use of the Platform is also subject to the BookOnMe Privacy Policy, which describes how personal information is collected, used, stored, and disclosed.

By using the Platform, users acknowledge that they have read and understood the Privacy Policy.

15. Availability and Accuracy of Content

BookOnMe does not guarantee that the Platform, or any content, listing, description, availability information, venue details, schedules, pricing displays, images, menus, event information, promotional content, or other materials made available through the Platform will be accurate, complete, reliable, current, error-free, or uninterrupted.

The Platform may contain technical, typographical, display, pricing, synchronization, or other errors.

BookOnMe reserves the right to correct errors, omissions, or inaccuracies and to change or update information at any time without prior notice.

Nothing on the Platform constitutes a guarantee of venue availability, event occurrence, service quality, or uninterrupted access.

16. Disclaimers

To the fullest extent permitted by applicable law, the Platform and all related content, software, functionality, and materials are provided on an "as is" and "as available" basis.

BookOnMe makes no representations or warranties of any kind, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, compatibility, security, or uninterrupted operation.

BookOnMe does not warrant that:

  • the Platform will always be available, secure, or error-free
  • defects will be corrected
  • the Platform is free from viruses or harmful components
  • any content or listing is complete, current, or accurate
  • any booking, request, payment flow, or integration will always be successfully completed

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to certain users to the extent prohibited by law.

17. Limitation of Liability

To the fullest extent permitted by law, BookOnMe shall not be liable for:

  • venue or organizer operations
  • service delivery failures
  • event cancellations or postponements
  • venue staff conduct
  • denial of entry by venues
  • venue policy enforcement
  • booking or service disputes between users and venues
  • refund decisions made by venues or organizers
  • indirect, incidental, consequential, special, exemplary, or punitive damages
  • loss of profits, revenue, business, goodwill, data, or opportunity
  • inaccuracies or interruptions in Platform content or availability
  • actions or omissions of third-party providers, venues, organizers, or payment institutions

BookOnMe's role is limited to providing technological infrastructure and related processing functions.

Where liability cannot be excluded, BookOnMe's aggregate liability shall be limited to the amount of platform fees, if any, paid by the user to BookOnMe in relation to the specific transaction giving rise to the claim, except where a greater amount is required by applicable law.

18. Account Suspension and Termination

BookOnMe may suspend, restrict, or terminate access to the Platform or a user account where reasonably necessary, including in cases of:

  • fraud or suspected fraud
  • repeated no-shows
  • abuse of the Platform
  • payment disputes or unjustified repeated chargebacks
  • violations of these Terms or other Platform policies
  • conduct that may expose BookOnMe, venues, or other users to legal, financial, or operational risk

BookOnMe may also remove or disable access to any content, booking functionality, or account feature where required for security, legal compliance, or operational protection.

19. Force Majeure

Neither BookOnMe nor, where applicable, venues or organizers shall be liable for failure or delay in performance caused by circumstances beyond reasonable control, including:

  • natural disasters
  • government actions or restrictions
  • public health emergencies
  • labor disputes
  • telecommunications failures
  • internet disruptions
  • infrastructure outages
  • cybersecurity incidents
  • other force majeure events

20. Governing Law

These Terms, and any non-contractual obligations arising out of or in connection with them, shall be governed by the laws of the jurisdiction in which the Platform operator is registered, without regard to conflict of law principles, except where mandatory consumer protection laws require otherwise.

21. Modifications to Terms

BookOnMe may revise or update these Terms at any time.

Any updated version becomes effective when published on the Platform, unless otherwise stated.

Continued access to or use of the Platform after updated Terms are published constitutes acceptance of the revised Terms.
